We recall that earlier Russia imposed a number of restrictions on entry of pork products, which de facto impede the import of pork from the whole territory of the EU. EC requested consultations on the Russian Federation imposed bans on pork imports in connection with cases of infection of African swine fever virus. Request of consultation aimed at dispute resolution procedures under the World Trade Organization.
The EU relies on the fact that the introduction of appropriate measures by the Russian Federation have not been addressed a number of important provisions of the Agreement on Sanitary and Phytosanitary Measures relating to the exploration risk, reasonableness in introducing measures, ttheir correspondence to the nature of risk, etc. Furthermore, the EU points to a number of procedural violations. Practice of resolving disputes in the WTO similar cases suggests that any of these violations, if it is determined by the panel, may lead to the recognition sanitary restrictions on imports of pork imposed by the Russian Federation, as well as accompanying measures be inconsistent with World Trade Organization agreements.
